Avenly is a caregiving coordination application that helps you organize care among the members of a care circle. Avenly is operated by LavaWave LLC, a California limited liability company (“LavaWave,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, and disclose information in connection with the Avenly mobile application and related services (the “Service”).

Care circle members. Information you enter is shared with the members you invite to your care circle, so that you can coordinate care together.
Service providers. We share information with vendors that process it on our behalf and under our instructions:
Legal and protective disclosures. We may disclose information if we believe it is reasonably necessary to comply with a law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of our users, the public, or LavaWave.
Business transfers. If LavaWave is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy.
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
Care and medication information you enter is used solely to provide the Service to you and the care circle members you invite. It is encrypted in transit and at rest, stored on Google’s secured infrastructure, and disclosed only to your care circle members. We do not use this information for any purpose other than providing the Service.
The Service allows you to enter information about the people in your care, who may include other adults or minors. You are responsible for the information you enter about another person. By entering it, you represent that you have the authority to provide that information and to have it processed as described in this Policy. Information you enter about a minor in your care is provided by you as the responsible adult.
We retain your information for as long as your account is active. You may delete your account and its associated data at any time within the app, in Settings, by selecting “Delete account,” or by emailing us at support@avenlycare.com. We will delete the information within 30 days of your request, except where we are required to retain it by law.
We use reasonable, industry-standard safeguards designed to protect your information, including encryption in transit and at rest. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we work to protect your information.
Avenly is intended for adults and is not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will take appropriate steps to delete it. Information about a minor who is a care recipient is addressed in Section 6 and is provided by the responsible adult.
You can review and update your account information within the app at any time, and you can delete your account and associated data as described in Section 7. To make a privacy request, contact us at support@avenlycare.com. We verify requests using the email address associated with your account, and we will not discriminate against you for exercising your rights.
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), provides the rights described in this section.

We collect this information directly from you and, for subscription status, from the Apple App Store and Google Play. We use it for the business purposes described in this Policy. We do not sell or share personal information for cross-context behavioral advertising, and we have not done so in the preceding 12 months. We use sensitive personal information only to provide the Service, and for purposes that do not give rise to a right to limit its use under the CCPA.
Subject to the CCPA, California residents have the right to know about and access the personal information we collect, to request deletion of their personal information, to request correction of inaccurate personal information, to limit the use of sensitive personal information, and to be free from discrimination for exercising these rights. Depending on your state of residence, you may have additional rights regarding your personal information, such as the right to access, correct, or delete it. To exercise any rights available to you, contact us at support@avenlycare.com, and we will respond to verified requests as required by applicable law.
We may update this Policy from time to time. If we make changes, we will post the updated Policy on this page and revise the “Effective Date” above. Your continued use of the Service after a change takes effect constitutes your acceptance of the updated Policy.
